Seasonal Workforce Solutions: Navigating the H-2B Visa Program
The H-2B program allows U.S. employers or U.S. agents who meet specific regulatory requirements to bring foreign nationals to the United States to fill temporary nonagricultural jobs.
The H-2B visa program is designed to address temporary labor shortages in non-agricultural industries by allowing U.S. employers to hire foreign workers for seasonal or peak-load positions.
Initially, H-2B visas are granted for the duration of the employer's approved temporary need, up to a maximum of one year. Extensions are possible, but the total stay is typically limited to three years.
The H-2B program is subject to an annual numerical cap. As of my last knowledge update in January 2022, the cap is set at 66,000 visas per fiscal year. Certain workers, such as those in the returning worker program, may be exempt from the cap.
